FTA Issues Dear Colleague Letter Announcing Guidance Updates Associated with the End of COVID-19 Disaster Declarations

In advance of the Federal Emergency Management Agency (FEMA)’s ending disaster declarations associated with the COVID-19 pandemic on May 11, 2023, FTA has issued a Dear Colleague Letter to grant recipients. This letter is to inform them they will no longer be able to use annual Section 5307 and non-Tribal 5311 funding at a 100 percent federal share for capital expenditures related to COVID-19 response.

Non-Tribal recipients may use annual appropriations of Section 5307 (Urban) or Section 5311 (Rural) formula funding at 100 percent federal share for COVID-19 related capital expenses only with grants obligated on or before May 11, 2023, as outlined in the updated FAQs under normal program eligibility, such expenses may still be eligible at an 80 percent Federal share if obligated after May 11, 2023.

There is no change in eligibility, period of availability, or Federal share for CARES, CRRSAA, and ARP funding.
