FTA Seeks Comment on Proposed Updates to the Joint Development Circular

Following changes to FTA’s Joint Development program made by the Bipartisan Infrastructure Law, FTA is requesting public comment on a potential change to the updated Joint Development guidance. The proposed guidance (Circular 7050.1C) will supersede Circular 7050.1B, once finalized.

FTA published a notice summarizing proposed changes to Circular 7050.1B in the Federal Register, with comments due by March 31, 2023.

The proposed update incorporates changes that added “technology to fuel a zero-emission vehicle” as an eligible joint development improvement under the definition of a “capital project.” These changes would impact eligibility criteria for FTA-assisted capital projects by changing fee collection requirements for joint development projects that include zero-emission vehicle charging.

FTA recommends that interested stakeholders review the proposed changes to the Circular and provide comment on any impacts they may have on future joint development projects.
